		<description>It is a tragedy that our industry refuses to move forward with education. Organized real estate fights any attempt to make it harder to become an agent or broker.  In California and most states,  once you pass the ridiculous license test,  you can:
1) Sell houses
2) Sell Mobile homes
3) Sell raw land (gulp)
4) Seller commercial buildings
5) Seller businesses
6)  Make loans 
7) Lease office building space
8) Property Manage
9) Sell residential Income property
10) Rural and mountain property
11) Income producing farms

I think you get my point.  Not only was this agent over their head,  what about the broker who allowed him to work on this project without first training him,  mentoring him or better yet, pull him off and give the deal to someone who is qualified. 

Tony made a comment regarding checking with the governmental agency.  Dangerous because the future reliance by future buyer would be on what the agent thought they understood from whomever they talked with at the counter.  You may not be aware that most planning and building departments have governmental immunity, meaning that they can&#039;t be relied upon.  And,  Even if they did get approval,  no agency will give FINAL approval for a plan until they get FULL PLANS.  And,  there are green belt overlays and all kinds of restrictions. 

What is unknown is what did the buyer do during their due diligence period?  Did Murphy blow that too.  Even if it was misrepresented on the MLS,  what&#039;s new about that.  No responsible buyer (or buyer&#039;s agent) would believe or rely upon anything a seller tells you upfront.
